What is a title clearance report and why do I need one?

A title clearance report is a legal review that ensures the title of your production (film, TV show, web series, etc.) does not infringe on any existing trademarks, copyrights, or the titles of other works. This report is vital to avoid conflicts with other projects that may have similar or identical titles. E&O insurance providers require a title clearance report to protect your production from potential legal claims related to the use of a specific title. It helps you verify that your chosen title is legally available, reducing the risk of having to change it late in the production process or face costly legal disputes.

Do I need a Title Clearance Report with Worldwide scope coverage or only covering U.S. & Canada?

E&O insurance providers generally require title clearance reports for the U.S. and Canada as a minimum, since these territories are particularly litigious and have stringent intellectual property laws. However, if your production is intended for worldwide distribution, some E&O insurers may require a global title clearance to ensure that your title is clear not just in North America but also in all international markets where the production will be released. For productions aiming for worldwide coverage, it’s essential to confirm whether the title is legally available in all territories, as legal standards and title protection can vary from country to country. Always check with your E&O insurance provider and distributors to understand their specific requirements based on the intended distribution territories of your production.

If an item in your script such as a character name, location, or product is flagged as being “ may not be clear” we will do our best to suggest alternative names for such item that are clear to use.  If it can be ascertained, we will also provide you with the applicable contact information required in order for you to attempt to secure permission to utilize the name of an item which would not be clear to use without such permission.   Certain items that are flagged as “may not be clear” may require further review by an entertainment lawyer to make a final legal determination as to whether the element can be used as is or needs to be modified. Our clearance report helps identify these areas, but we always recommend seeking legal advice to confirm.

Do you offer suggestions for names or elements that can’t be cleared?

Yes! If we determine that certain names or elements in your script can’t be cleared, we try to provide alternative suggestions that are ready to use. However, it’s important to note that certain flagged items might require additional review by an entertainment lawyer to make a legal determination about whether changes are necessary.

What if I need additional name clearances after the initial report is completed?

If you’ve made changes to your script or need to clear additional names after the initial clearance report has been completed, we can perform supplemental name clearances. Five supplemental name clearances are automatically included with every script clearance report ordered.  This process involves reviewing the newly added or modified names to ensure there are no legal issues or conflicts. Just like the original report, we use proprietary, patent-pending AI tools and human review to ensure accuracy and thoroughness. Depending on the complexity of the changes, additional legal review may be necessary to make a final determination on the use of certain names.
